The Supreme Court, in a 7-2 decisionHe extended his court order that temporarily prohibits the Trump administration of eliminating Venezuelan immigrants from the United States under the proclamation of the alien enemies law and sending the case to the 5th Court of Appeals of the United States Circuit to resolve the question of how much time should be provided so that the detainees challenge their remoctions.

The majority said that the government did not provide migrants directed under the authority of the war with enough time or information to dispute their cases.

“The interests of detainees at stake are particularly heavy. In these circumstances, the notification approximately 24 hours before the elimination, devoid of information on how to exercise the rights of due process to compete that the elimination is surely not approved,” the majority wrote in the decision. “But it is not optimal for this Court, far from the circumstances in the field, to determine in the first instance the necessary process to satisfy the Constitution in this case.”

The judges did not reach the question of the legality of the removals under the Aien Enemies Law.

“We recognize the importance of government national security interests, as well as the need for such interests to continue consistently with the Constitution. In the light of the lower courts, the lower courts must address AEA cases expedited,” they wrote.

Judges Samuel Alito and Clarence Thomas disagreed.

Earlier this week, the Trump administration asked the court to raise his mandate, arguing that the migrants who intended to deport by virtue of the law were dangerous.
